When should you use probate forms?

Sometimes probate forms are very helpful.  There are probate courts around the country that make these forms readily available.  However, there can be risk in using probate forms if you don’t know what you’re doing.  It is irresponsible for anyone to just give you forms and assume you can just figure it out for yourself.  Would you settle a million dollar divorce case with free divorce forms you found online?  Probably not.

  • The estate’s assets total value is very low.  (Most states have a maximum threshhold value determined before you should or need to consider hiring a probate attorney.)
  • There are few or negligible creditors claims.
  • You know how to assemble a complete probate petition package.  (Most forms require the support of other forms to assemble a complete probate petition/application to the court.

Do not use probate forms if/when:

  • You believe probate is a “very simple” process.  Probate is a court process – don’t take it for granted.
  • You don’t have cooperation between all of the heirs (Eg. If you believe someone is going to contest a Will, you should hire an attorney first.)
  • The state probate courts require attorney representation
